1. Acceptance of Terms
By accessing or using lendnest.us, you agree to be bound by these Terms of Service entered into with Term Loans US LLC, a Wyoming limited liability company, doing business as ("d/b/a") Lend Nest ("LendNest", "we", "us", or "our"). If you do not agree, you may not use our services.
2. We Are Not a Lender
IMPORTANT: LendNest is a referral and matching service that connects business owners with third-party funding partners. We are NOT a lender, bank, or financial institution. We do not make lending decisions, extend credit, or fund loans.
Our service connects businesses seeking financing with third-party lending partners. By submitting an inquiry, you authorize us to share your information with lending partners who may contact you, subject to the carve-outs described in Section 6.
3. Eligibility
To use our services, you must: be at least 18 years of age, be a United States resident or operate a US business, have legal authority to bind any business on whose behalf you submit an inquiry, and provide accurate and complete information.
4. How the Matching Process Works
When you submit a loan inquiry, your information is collected and stored, matched with lending partners, and transmitted to those partners who may contact you by phone or email. Lenders independently evaluate your application and determine whether to extend an offer.
5. No Guarantee of Approval or Rates
Submitting an inquiry does not guarantee loan approval. All credit decisions are made solely by individual lending partners. Rates, terms, and loan amounts advertised on our site are examples only and are not guaranteed.
6. Communication Consent
SMS / Text Messaging Consent (LendNest Only)
By checking the SMS opt-in box on our inquiry form, you agree to receive text messages from LendNest ONLY (not from third parties) regarding your funding inquiry. SMS messages may include application confirmations, requests for additional information, status updates, and related transactional communications about the inquiry you submitted.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. SMS consent is not a condition of any purchase or service.
Your mobile phone number and SMS consent will never be shared with or sold to third parties or affiliates for marketing purposes.
Lending Partner Contact (Separate from SMS Consent)
Separately from the SMS consent above, by submitting an inquiry on our website you authorize LendNest to share the other information contained in your inquiry (such as your name, email, business details, and funding request) with one or more third-party lending partners, and you authorize those lending partners to contact you by phone and email about your funding inquiry. This authorization expressly EXCLUDES your mobile phone number for SMS purposes and your SMS opt-in consent, and does NOT authorize third parties to send you text messages on our behalf or to text-market to you.
Email Communications
By submitting an inquiry, you consent to receive transactional and service emails from LendNest about your inquiry. You may unsubscribe from marketing emails at any time using the link in any email or by visiting our Unsubscribe page.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEND NEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100.00 USD.
8. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
9. Dispute Resolution & Governing Law
Any disputes shall be resolved through binding arbitration under AAA Consumer Arbitration Rules. You waive any right to a jury trial or class action. This agreement is governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles.
